  2. have legal capacity to enter into agreements;

  4. use the Platform in accordance with these Terms and applicable law.

4.2 Account Types

Users must register using the Account type that reflects how they intend to use Blinqo:

  1. Company;
  2. Worker/Tradesperson; or
  3. Property Owner.

4.3 Account Information

Users are responsible for ensuring that information provided through their Account is accurate, genuine and kept up to date.

Users must not:

  • impersonate another person or business;
  • provide false qualifications or certifications;
  • create misleading profiles; or
  • knowingly provide false or materially inaccurate information.

4.4 Company Accounts

A person using Blinqo on behalf of a Company confirms that they are authorised to act on behalf of that Company.

4.5 Worker/Tradesperson Accounts

Workers/Tradespeople are responsible for keeping relevant professional information current, including their:

  • trade;
  • skills;
  • experience;
  • qualifications;
  • certifications;
  • licences;
  • insurance; and
  • availability.

They are also responsible for holding any qualifications, licences, cards or registrations required for work they undertake.

4.6 Account Security

Users are responsible for maintaining the security of their Account and login credentials.

Any suspected unauthorised access should be reported to Blinqo promptly.

4.7 Verification

Blinqo may request additional information or documents to verify a User's identity, business, qualifications or other relevant information.

Failure to provide reasonably requested verification information may result in restricted access to certain Platform features.

4.8 Account Restrictions

Blinqo may refuse registration or restrict or suspend an Account where reasonably necessary to:

  • protect Users;
  • prevent fraud or misuse;
  • enforce these Terms; or
  • comply with legal or regulatory requirements.

4.9 Closing an Account

Users may request closure of their Account, subject to any outstanding payments, active Connections, disputes or other obligations.

Closing an Account does not automatically require Blinqo to delete information that it is permitted or required to retain.

5. How Blinqo Works

5.1 General

Blinqo facilitates construction-related Jobs, Projects, Matches and Connections between Users.

Matching may take into account information such as:

  • trade;
  • skills;
  • qualifications;
  • experience;
  • location;
  • availability; and
  • relevant Job or Project requirements.

A Match does not guarantee that a User will be selected, engaged or suitable for a particular opportunity.

5.2 Company → Worker/Tradesperson

A Company may use Blinqo to find Workers/Tradespeople for construction-related workforce requirements.

The process may include:

  1. the Company posting or submitting its workforce requirement;
  2. Blinqo presenting potentially suitable Workers/Tradespeople;
  3. the Company reviewing available profiles or Matches; and
  4. Blinqo facilitating a Connection where appropriate.

Any applicable Blinqo fee for this service is payable by the Company.

A Worker/Tradesperson will not be charged by Blinqo for being matched or introduced to a Company for employment or engagement.

5.3 Property Owner → Company

A Property Owner may post a Project requiring construction, renovation, refurbishment, maintenance, repair or related services.

Relevant Companies may be able to view, receive, express interest in or connect with the Project.

The Property Owner is responsible for deciding which Company, if any, they wish to engage.

Any applicable Platform Fee will be shown to the relevant User before it becomes payable.

5.4 Property Owner → Worker/Tradesperson

A Property Owner may also post a Project suitable for an individual Worker/Tradesperson.

The process may include:

  1. the Property Owner posting the Project;
  2. Workers/Tradespeople viewing the Project and expressing interest;
  3. the Property Owner reviewing interested Workers/Tradespeople;
  4. the Property Owner selecting or accepting a Worker/Tradesperson;
  5. the selected Worker/Tradesperson paying any applicable Connection Fee;
  6. Blinqo releasing or unlocking relevant contact details following successful payment; and
  7. the parties communicating directly to agree the scope, price, timing and terms of the work.

The Connection Fee is payable for the relevant Blinqo Platform service and is separate from the price charged for the underlying work.

5.5 User Selection

Blinqo may assist Users in discovering relevant opportunities or Users, but the final decision to select, hire, engage or contract with another User remains with the relevant Users.

5.6 Agreements Between Users

Unless expressly stated otherwise, agreements for the actual construction, trade or other services are entered into directly between the relevant Users.

The parties are responsible for agreeing matters such as:

  • scope of work;
  • price;
  • payment terms;
  • start and completion dates;
  • materials;
  • access arrangements; and
  • warranties or guarantees.

5.7 Payments for the Underlying Work

Unless Blinqo expressly provides otherwise for a particular service, Blinqo does not collect or hold payment for the underlying construction or trade work.

Platform Fees payable to Blinqo are separate from payments made between Users for the actual work.

6. Posting Jobs & Projects

6.1 General Requirements

Companies and Property Owners may post Jobs or Projects through the Platform where the relevant functionality is available.

Users must ensure that information provided in a listing is accurate, genuine and sufficiently clear for other Users to understand the opportunity.

6.2 Company Job Postings

A Company posting a Job should provide relevant information such as:

  • role or trade required;
  • location;
  • expected start date and duration;
  • working hours where relevant;
  • required skills, experience or qualifications;
  • required cards, licences or certifications;
  • pay or payment arrangements where applicable; and
  • relevant site or health and safety information.

6.3 Property Owner Project Postings

A Property Owner posting a Project should provide relevant information such as:

  • type and description of work;
  • Project location;
  • expected scope;
  • preferred timeframe;
  • budget or estimated Project value where requested;
  • relevant photographs; and
  • known circumstances that may materially affect the work.

6.4 Accuracy and Updates

Users are responsible for the accuracy of listings they submit and should update material information where circumstances change.

6.5 Prohibited Listings

Users must not post Jobs or Projects that are:

  1. false, misleading or fraudulent;
  2. unlawful;
  3. materially misrepresented;
  4. unlawfully discriminatory;
  5. intended primarily to collect personal information or advertise unrelated services; or
  6. otherwise in breach of these Terms.

6.6 Safety Information

Companies and Property Owners must disclose relevant information reasonably known to them about site conditions, access restrictions, hazards or other circumstances that could materially affect safe performance of the work.

Use of Blinqo does not replace any health and safety duties imposed by law.

6.7 Review and Removal

Blinqo may review, reject, amend, suspend or remove a listing where it reasonably believes that the listing:

  • breaches these Terms;
  • is materially inaccurate or misleading;
  • creates a legal, safety or fraud risk; or
  • is no longer genuine or current.

Blinqo is not required to independently verify every listing before publication.

7. Matching, Selection & Connections

7.1 Matching

Blinqo may use relevant User and opportunity information to identify or present potentially suitable Matches.

Matching may take into account factors such as trade, skills, qualifications, experience, location, availability and Job or Project requirements.

7.2 No Guarantee or Endorsement

A Match, search result, suggestion or introduction does not constitute a guarantee or endorsement that a User is suitable for a particular Job or Project.

Users remain responsible for making their own assessment.

7.3 Selection

The final decision to select, accept, hire, engage or contract with another User remains with the relevant Users.

7.4 User Checks

Users should carry out checks reasonably appropriate to the work before proceeding with another User.

These may include checking:

  • identity;
  • qualifications;
  • certifications or construction cards;
  • licences or registrations;
  • insurance;
  • experience;
  • references; and
  • right to work where applicable.

Any verification provided by Blinqo does not remove the User's responsibility to carry out appropriate checks.

7.5 Connections

A Connection occurs when Blinqo enables or facilitates direct communication between relevant Users.

Certain Connections may require payment of a Platform Fee before contact details or other Connection functionality are made available.

7.6 Contact Details

Contact information obtained through Blinqo must only be used for the legitimate Job, Project or business purpose for which it was provided.

Users must not sell, publish, distribute or misuse another User's contact information.

7.7 After a Connection

Once Users are connected, they are responsible for negotiating and agreeing any underlying employment, engagement, construction or service arrangement directly.

7.8 No Guarantee of Outcome

Blinqo does not guarantee that:

  1. a Match will result in a Connection;
  2. a Connection will result in employment, engagement or a contract;
  3. work will proceed or be completed; or
  4. payment for the underlying work will be made.

8. Fees, Payments, Cancellations & Refunds

8.1 Platform Fees

Blinqo may charge fees for certain Platform Services.

Any applicable fee, payment trigger and material conditions will be displayed or communicated before the User becomes liable to pay it.

8.2 Company → Worker/Tradesperson

Where a Company uses Blinqo to find or connect with a Worker/Tradesperson, the applicable Blinqo fee is payable by the Company.

The Worker/Tradesperson will not be charged by Blinqo for being matched or introduced to a Company for employment or engagement.

8.3 Property Owner → Company

A Company may be required to pay a Platform Fee for accessing, claiming or connecting with a Property Owner's Project.

The applicable fee will be shown before it becomes payable.

8.4 Property Owner → Worker/Tradesperson

Where a Property Owner selects or accepts a Worker/Tradesperson for a Project, the selected Worker/Tradesperson may be required to pay an applicable Connection Fee before direct contact details are released.

Workers/Tradespeople may view and express interest in relevant Projects without paying the Connection Fee.

The Connection Fee is separate from any amount agreed for the underlying work.

8.5 Payment Does Not Guarantee Work

Payment of a Platform Fee does not guarantee that the parties will enter into or complete an employment, engagement, construction or service agreement.

Where a fee relates to a Connection, the service purchased from Blinqo is the relevant access, introduction or Connection.

8.6 Payment Processing

Payments may be processed through third-party payment providers and may also be subject to that provider's terms and privacy practices.

8.7 Cancellations and Refunds

Cancellation of a Job, Project or Connection does not automatically entitle a User to a refund.

A full or partial refund may be provided where appropriate, including where:

  1. a fee was charged incorrectly or more than once;
  2. a Blinqo technical failure prevented the paid service from being provided;
  3. the relevant listing was materially false or fraudulent;
  4. the paid Connection or contact information was not provided due to a failure attributable to Blinqo;
  5. contact details provided through a paid Connection were materially invalid or unusable; or
  6. applicable law requires a refund.

Where contact details are materially invalid or unusable, the User should notify Blinqo promptly. Blinqo may investigate and, where appropriate, provide corrected information, a replacement Connection or a full or partial refund.

A refund will not normally be provided merely because the Users later decide not to proceed, cannot agree commercial terms, or the underlying work does not proceed for reasons outside Blinqo's control.

Nothing in these Terms affects any statutory cancellation or refund rights that cannot lawfully be excluded.

8.8 Failed or Reversed Payments

Where a payment fails, is reversed or is subject to a valid chargeback, Blinqo may withhold or restrict the relevant paid feature or Connection until payment is resolved.

8.9 Fee Changes

Blinqo may change Platform Fees from time to time.

Changes will not normally apply retrospectively to fees that have already become payable.

9. Anti-Circumvention & Platform Misuse

9.1 Circumvention

Users must not deliberately use Blinqo to discover or connect with another User and then bypass a required Platform Fee or Connection process.

9.2 Prohibited Conduct

Users must not:

  1. exchange contact details before permitted where a Connection is subject to a fee or controlled process;
  2. place contact details in profiles, listings, photographs or other fields where this is not permitted;
  3. encourage another User to avoid an applicable Platform Fee;
  4. create false or duplicate Accounts to avoid Platform rules or charges; or
  5. misrepresent whether a Connection, placement or Project occurred.

9.3 Existing Relationships

Blinqo will not charge a fee solely because two Users had a genuine pre-existing relationship independent of the Platform.

Blinqo may request reasonable evidence where this is relevant to a fee dispute.

9.4 Fees Following a Blinqo Connection

Where a Platform Fee has properly become payable because Blinqo provided a Match, introduction or Connection, moving subsequent communication outside the Platform does not remove that payment obligation.

9.5 Enforcement

Where Blinqo reasonably believes that a User has deliberately circumvented the Platform, Blinqo may:

  • require payment of properly due fees;
  • restrict Platform functionality;
  • suspend or terminate the Account; or
  • take other proportionate action permitted by law.

9.6 Direct Dealings After a Valid Connection

Once the relevant Blinqo Connection process has been completed and any properly due Platform Fee has been paid, Users may deal directly with each other in relation to the underlying work.

10. Verification & User Checks

10.1 Verification

Blinqo may offer verification features in relation to information such as:

  • identity;
  • business or company details;
  • trade or occupation;
  • qualifications and certifications;
  • construction cards;
  • licences or registrations; and
  • insurance.

The type and extent of verification may vary between Users, and Users should check the specific verification status shown on a profile.

10.2 Meaning of “Verified”

A “Verified” badge or status means only that Blinqo has completed the checks specified for that verification status at the relevant time.

10.3 Verification Is Not a Guarantee

Verification does not guarantee or endorse a User's:

  • competence;
  • workmanship;
  • reliability;
  • suitability for a particular Job or Project;
  • financial standing; or
  • ongoing compliance with legal or professional requirements.

Users remain responsible for making their own assessment before engaging another User.

10.4 User Responsibility

Information and documents submitted for verification must be genuine, accurate and current.

Users must not submit forged, altered, expired or misleading documentation.

10.5 Expiry and Changes

Users should update relevant verification information where a qualification, card, licence, registration or insurance policy expires or materially changes.

Blinqo may remove or amend a verification status where the relevant information is no longer current or appears inaccurate.

10.6 False Verification Information

Where Blinqo reasonably believes that false or fraudulent verification information has been provided, it may reject or remove the verification and restrict, suspend or terminate the relevant Account.

11. User Conduct & Acceptable Use

11.1 General Conduct

Users must use the Platform lawfully, honestly and professionally.

Users must not use Blinqo in a way that harms other Users, Blinqo or the integrity of the Platform.

11.2 Prohibited Activities

Users must not:

  1. provide false, fraudulent or misleading information;
  2. impersonate another person or business;
  3. upload forged or misleading documents;
  4. post fake Jobs or Projects;
  5. use the Platform for unlawful or deceptive purposes;
  6. harass, threaten, abuse or unlawfully discriminate against another User;
  7. send spam or unrelated advertising;
  8. misuse another User's personal information;
  9. introduce malware or attempt unauthorised access to the Platform;
  10. scrape or systematically extract Platform data without permission;
  11. manipulate reviews, verification or matching systems; or
  12. deliberately circumvent Platform Fees or Connection processes.

11.3 Safety

Users must not knowingly request, offer or carry out work through Blinqo in an unlawful or unsafe manner.

Users remain responsible for complying with any health and safety duties applicable to their role.

11.4 Reviews and Feedback

Any review or rating submitted through Blinqo must reflect a genuine experience.

Blinqo may remove or restrict reviews that are fake, abusive, misleading or otherwise breach these Terms.

11.5 Reporting Misuse

Users may report suspected fraud, unsafe activity, fake listings, abusive behaviour or other serious breaches of these Terms.

Blinqo may investigate and take proportionate Platform-level action.

11.6 Availability and Attendance

When a Worker/Tradesperson confirms availability for a Job, they confirm that they can start on the stated date and will attend if selected.

Where a Company reports that a Worker/Tradesperson did not attend, Blinqo may issue a warning and, after repeated reports, restrict the Worker/Tradesperson from receiving or confirming new opportunities, in line with Section 16.

Users may contact Blinqo if they believe a report was made in error.

12. User Content & Intellectual Property

12.1 User Content

Users may submit Content to the Platform, including profiles, business information, Job or Project descriptions, photographs, qualifications, documents, reviews and messages.

12.2 Ownership and Licence

Users retain ownership of Content they submit.

By submitting Content, the User grants Blinqo a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, process and use that Content where reasonably necessary to operate, improve and promote the Platform.

12.3 User Responsibility

Users must have the necessary rights and permissions to submit Content.

Users must not upload Content that:

  1. infringes another person's rights;
  2. contains personal information without appropriate authority;
  3. is false or materially misleading;
  4. is defamatory, threatening, abusive, discriminatory, obscene or unlawful; or
  5. contains malicious software or harmful code.

12.4 Photographs and Documents

Users should avoid unnecessarily uploading identifiable individuals, confidential information, security details or other sensitive information in photographs or documents.

Verification documents will not ordinarily be made public unless clearly stated otherwise.

12.5 Blinqo Intellectual Property

The Blinqo name, branding, logo, software, interface, design, database and original Platform materials are owned by or licensed to Blinqo.

Users must not copy, reproduce, distribute or commercially exploit Blinqo intellectual property without permission, except as permitted through normal use of the Platform.

12.6 Removal of Content

Blinqo may remove or restrict Content where reasonably necessary because it:

  • breaches these Terms;
  • may infringe another person's rights;
  • creates a fraud, safety or security concern; or
  • must be removed to comply with law.

13. Construction Work, Contracts & Responsibilities

13.1 Blinqo's Role

Blinqo facilitates Matches, introductions and Connections.

Unless expressly stated otherwise, Blinqo does not carry out, supervise or manage construction, renovation, refurbishment, repair or maintenance work arranged between Users.

13.2 Contract Between Users

Where a Property Owner engages a Company or Worker/Tradesperson through Blinqo, the agreement for the underlying work is entered into directly between those Users.

Blinqo is not a party to that agreement unless expressly agreed otherwise in writing.

13.3 Terms of the Work

The relevant Users are responsible for agreeing matters including:

  • scope and specification;
  • price and payment terms;
  • materials;
  • start and completion dates;
  • access arrangements;
  • variations;
  • warranties or guarantees; and
  • other relevant commercial terms.

Users should record material terms in writing.

13.4 Payment for the Work

Unless Blinqo expressly provides otherwise, payment for the underlying construction or trade work is made directly between the relevant Users.

Blinqo Platform Fees are separate from payment for the actual work.

13.5 Performance of the Work

The Company or Worker/Tradesperson undertaking the work is responsible for its performance and for complying with applicable professional and legal requirements.

13.6 Qualifications, Insurance and Approvals

Companies and Workers/Tradespeople are responsible for maintaining any licences, qualifications, registrations, certifications or insurance required for the work they undertake.

The relevant Users are also responsible for determining whether planning permission, building regulations approval or other consent is required.

13.7 Health and Safety

Each User remains responsible for health and safety duties applicable to their role and the relevant work.

13.8 Defects, Delays and Disputes

Issues concerning workmanship, delays, incomplete work, materials, variations, damage or payment for the underlying work should normally be addressed between the Users who entered into that agreement.

Blinqo may take Platform-level action where appropriate but is not responsible for carrying out, correcting or paying for the underlying work.

13.9 Consumer Rights

Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded under applicable consumer law.

14. Liability, Disclaimers & Platform Availability

14.1 Platform Role

Blinqo provides a Platform for matching, introductions and Connections.

Except where expressly stated otherwise, Blinqo does not control or supervise work carried out by Users.

14.2 User Information and Verification

Blinqo may take reasonable steps to support accurate information and verification, but does not guarantee that information supplied by Users is accurate, complete or current.

Users remain responsible for carrying out appropriate checks.

14.3 No Guarantee of Outcome

Blinqo does not guarantee that:

  1. a Worker/Tradesperson will receive work;
  2. a Company will find a suitable Worker/Tradesperson or Project;
  3. a Property Owner will find a suitable Company or Worker/Tradesperson;
  4. a Match will result in a successful Connection or agreement; or
  5. any Job or Project will proceed or be completed.

14.4 Underlying Work

Subject to applicable law, Blinqo is not responsible for the acts or omissions of Users in relation to the underlying work, including workmanship, delays, materials, site conditions or compliance with agreements entered into directly between Users.

This does not exclude responsibility that legally belongs to Blinqo for its own acts or omissions.

14.5 Payments Between Users

Where payment for underlying work is made directly between Users, Blinqo is not responsible for collecting, holding or recovering those payments unless Blinqo has expressly agreed to provide that service.

14.6 Platform Availability

Blinqo does not guarantee uninterrupted or error-free availability of the Platform.

Access may occasionally be restricted because of maintenance, technical failures, security issues or circumstances outside Blinqo's reasonable control.

14.7 Third-Party Services

The Platform may rely on third-party services such as payment, hosting, communications or verification providers.

Subject to applicable law, Blinqo is not responsible for failures caused solely by third-party services outside its reasonable control.

14.8 Liability That Cannot Be Excluded

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  1. death or personal injury caused by negligence;
  2. fraud or fraudulent misrepresentation; or
  3. any other liability that cannot lawfully be excluded.

14.9 Business Users

For Users acting in the course of a business, trade or profession, Blinqo will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of anticipated savings, except where such liability cannot lawfully be excluded.

14.10 Consumer Users

Nothing in these Terms affects statutory rights available to Users acting as consumers.

15. Complaints, Disputes & Reporting

15.1 Complaints About Blinqo

Users may submit complaints concerning matters such as:

  • Accounts or verification;
  • Platform Fees or payments;
  • Matches or Connections;
  • Platform functionality; or
  • decisions taken by Blinqo.

15.2 Complaints About Other Users

Users may report concerns relating to another User, including suspected:

  • fraud;
  • misleading information;
  • false qualifications;
  • abusive or discriminatory behaviour;
  • misuse of personal information;
  • unsafe or unlawful activity; or
  • fake Jobs or Projects.

15.3 Disputes Concerning Underlying Work

Disputes relating to the underlying construction or trade agreement, including workmanship, delays, payment, materials, variations or damage, should normally be resolved directly between the relevant Users.

Blinqo may provide reasonable Platform-level assistance but is not responsible for determining legal liability between Users.

15.4 Blinqo Action

Where Blinqo reviews a complaint or report, it may request relevant information or evidence.

Depending on the circumstances, Blinqo may:

  1. take no further action;
  2. issue a warning;
  3. remove or restrict Content;
  4. amend or remove a verification status;
  5. restrict Platform functionality;
  6. suspend or terminate an Account; or
  7. consider a refund where appropriate.

15.5 Immediate Action

Blinqo may take immediate temporary action where reasonably necessary to protect Users, prevent fraud, address a safety or security concern, preserve evidence or comply with law.

15.6 Evidence

Users should retain relevant evidence relating to Jobs, Projects and agreements, including quotations, contracts, invoices, photographs and communications.

15.7 No Guarantee of Resolution

Blinqo cannot guarantee that every dispute between Users will be resolved through the Platform.

Users may need to pursue their rights directly against another party or through an appropriate court, tribunal or dispute-resolution process.

16. Account Suspension, Termination & Closure

16.1 Suspension or Restriction

Blinqo may restrict or suspend all or part of an Account where it reasonably believes that:

  1. the User has materially breached these Terms;
  2. false, fraudulent or misleading information has been provided;
  3. the Account is being used for fraud, scams or unlawful activity;
  4. verification information appears false, altered or invalid;
  5. the User has attempted to circumvent applicable Platform Fees;
  6. the User's activity creates a material safety, security or privacy risk;
  7. properly due Platform Fees remain unpaid; or
  8. action is required by law or a competent authority.

16.2 Proportionate Restrictions

Where appropriate, Blinqo may restrict specific features rather than suspend an entire Account.

This may include restricting the ability to post Jobs or Projects, express interest, make Connections or access contact information.

16.3 Termination

Blinqo may terminate an Account where there has been a serious or repeated breach of these Terms, fraud or unlawful activity, persistent non-payment, or another material risk to the Platform or its Users.

16.4 Notice

Where reasonably practicable, Blinqo will inform the User of the reason for a significant restriction, suspension or termination.

Immediate action may be taken where reasonably necessary to prevent fraud, protect Users, address an urgent safety or security issue, or comply with law.

16.5 Closing an Account

Users may request closure of their Account.

Closing an Account does not remove obligations that arose before closure, including properly due Platform Fees or existing agreements entered into with other Users.

16.6 Active Jobs, Projects & Connections

Following suspension, termination or closure, Blinqo may remove or deactivate active Jobs or Projects and restrict new Connections.

Agreements already entered into directly between Users are not automatically terminated by closure of a Blinqo Account.

16.7 Data After Closure

Following Account closure, Blinqo may delete, anonymise or retain information in accordance with its Privacy Policy and applicable law.

17. Privacy & Data Protection

Blinqo processes personal information in connection with registration, verification, Jobs, Projects, matching, Connections, payments, communications and use of the Platform.

Personal information will be handled in accordance with Blinqo's Privacy Policy and applicable UK data-protection law.

Users receiving another User's personal information through Blinqo must only use it for the legitimate purpose for which it was provided and must not sell, publish or misuse it.

18. Changes to the Platform & These Terms

18.1 Platform Changes

Blinqo may update, modify, add or remove Platform features where reasonably necessary for operational, technical, security, commercial or legal reasons.

18.2 Changes to These Terms

Blinqo may update these Terms to reflect changes to:

  • the Platform or Services;
  • the business model or fee structure;
  • legal or regulatory requirements;
  • security or fraud-prevention measures; or
